13 NGOs: Election of the Director of RTCG defeat the rule of law

Human Rights (HRA), Spektra Association, Center for Civic Education (CCE), Center for Monitoring and Research (CEMI), Center for Women's Rights, Center for Civil Freedoms (Cegas), Center for Democracy and Human Rights (CEDEM) , European Association for Law and Finance (EALF), Alternative Institute (IA), Juventas, MEDIA Center, and Queer Montenegro are protesting from the unlawful choice of Boris Raonić for the director of RTCG.

These 13 NGOs called on the members of the RTCG Council, who participated in the election to resign public functions for ignoring the final court decision and assuming private interests to the public interest.

It is unacceptable, as they pointed out, that any public official, including members of the Public Service Council, abuses public office by ignoring a final court decision and nitread the rule of law.

In the present case, the Court recently resigned the decision on the election of Boris Raonić for the director of RTCG was not allowed to be chosen to that function as the conflict of interest as a member of the Council of the Agency for Electronic Communications . However, it has now again chosen to the same function, President of the Council of RTCG Veselin Drljević and the members of RTCG Amina Murić, OD Zorić and Filip Lazic and their duties to respect the instructions from the competent court, which prescribes a member 34 paragraph 2 of the Law on the National Public Broadcase - state in the announcement.

The law clearly prescribed that "No one has the right to do the work of the Council, nor does the Council of Council suffer that POS sorrow either instructions regarding their work, except for the decisions of the .

There is no dilemma about how to vor the instruction from the final judgment. The High Court in Podgorica precisely pointed out that the "legal consequences of the decision on appointment is re-reported from the applicants, in which the Procedure is the opportunity to reconsider the remaining applications and to decide in accordance with the law.

They also point out, based on this decision, the Council of RTCG had only two possibilities: (1) to cancel the competition and announce new, or (2) to make a choice between the remaining candidates per contentious competition. However, the contrary, the Council of RTCG has decided to re-commit the disputed competition between all original candidates and select a person for which the Court has already established not to meet the requirements prescribed by the competition.

By choosing candidates on the conditions of the competition from 2021 and the involvement between the Raonić, the mentioned five members of the Council were consciously misused by the official position and inflicted the damage to the public interest - state in the statement.

Montenegro, notes from NGOs, must establish the rule of law at all levels of all public services, including public service. All public officials, including members and members of the Council of RTCG must respect court decisions, and is very dangerous to the entire system when they are precisely the rule of law.

Therefore, we believe that the first step is in the attempt to restore the work of the public service in the legal framework to make these five members of the Council emergently resign and their careers continue from any public office. Their further stay in these positions does not only apply reputation damage to the public service RTCG but also the state of Montenegro, which will undoubtedly be stated and in all relevant international reports - concludes in the statement of 13 NGOs.
