Brđanin sued the Government: the decision to remove illegal

The lawyer of Siniša Gazivoda as a proxy of Zoran Brdjanin submitted to the Administrative Court of lawsuit against the Government of Montenegro on the termination of the Director of the Police Directorate and the decision on the duties of the Director of the Police Management.

Gazivoda says the Government of Montenegro brought an illegal decision on the termination of the Officer of the Director of the Police Directorate with the wrong and incomplete factual situation and violations of the rules of procedure.

"Such decision-making on the premise termination of the Director of the Police Directorate, which does not have a legitimate goal and represent a threat to the operational independence and political neutrality by which the director of this part of the system," Gazivoda said.

As he pointed out, the need for a democratic society is to consistently implement the principle of legality and rule of law, and in order to achieve this, there must be an efficient control system.

"In the specific case, the Administrative Court, ie judicial control through an administrative dispute. In this way, the protection of citizens from self-sufficiency is ensured by the authorities, which is precisely the subject of this claim. The lawsuit is argued and the so-called Strasbourg The standards, ie the recommendations of the Council of Europe in this area, as well as the court practice of the European Court of Human Rights, especially in the part of the right, fast and efficient trial and the guarantee of effective legal remedies, which applies to the termination of the injury or preventing its Continuation, "Gazivoda said.

The Brdjanin was removed on March 30.

At the session on which he was decided on that, the Minister of Justice Marko Kovač said the removal of Brdjana was an unpleasant decision and politically unpopular.

"But we have to make it, regardless of the all questionability of the legal procedure that exists, because the termination of the mandate may be questionable from the point of view of the right," Kovac then warned.

The Minister of the Interior Filip Adzic announced reforms at almost all positions in the police at that session.

Minister without portfolio Zoran Miljanić appealed to Minister of Finance Aleksandar Damjanović to be adequately rewarded by the police officers of the Special Police Department and that their mucoted multi-month work was thus admitted.

Prime Minister Dritan Abazovic said the government gives full support to all people within the security sector, to clear all staff who are in any way to support criminal groups.
