Katnić wrote to Novović: I ask that you urgently hear me again, the prosecutor and the lawyer put pressure on me

Former Chief Special Prosecutor Milivoje Katnić, who is in detention where he is on a hunger strike, sent a second letter to Chief Special Prosecutor Vladimir Novović, in which he asks him to be questioned urgently due to his health condition so that he can present new facts and circumstances regarding criminal offenses which are charged to him.

Katnić, in a letter to Novović, reports the Standard, points to the pressure he was exposed to by the prosecutor Šoškić, who prevented Katnić from hearing witnesses as part of his official duties.

Milivoj Katnić's letter to the Chief Special Prosecutor Vladimir Novović is transmitted in its entirety:

Until now, I have approached Mr. Novović several times to allow me to participate in the criminal proceedings that are being conducted against me. I addressed the same request to the Protector of Human Rights after that, but I don't know if that's why I was invited to attend the hearing of a witness who has no knowledge of the crimes I am accused of.
Because of the above, and as I wrote to you before, I perceive this procedure only as a simulation that I have been approved to participate in the procedure.

This is my address to you as Chief Special Prosecutor. That's why I ask once again to be called urgently and without delay because I want to supplement my defense.

I ask you, Mr. Novović, as the Chief Special Prosecutor, to enable my basic right, which is to participate in the proceedings in a functional and effective manner.

I am also in custody on the basis of detention in accordance with Article 175 paragraph 1 point 2 of the Criminal Code, which is not to influence witnesses, however, in the criminal proceedings, witnesses were also heard, which hearings I could not attend because that right was unlawfully denied to me.

In front of the investigating judge, I refused, and it went into the record that an ex-officio defense attorney participates in my defense and that they cannot take any action on my behalf in this case. And finally, I told him that regardless of whether he is called by the prosecution or the court, he should not respond in this criminal case. I told him that in front of the investigating judge and in front of the prosecutor Šoškić.

However, an incredible situation happened that the prosecutor Šoškić called this defense attorney during the hearing of the witness that I attended. And what is even worse, despite the exclusive request and expressed will that he cannot act in the case as my counsel, he attended the hearing of witnesses in the case as my counsel. Then I told him everything I told him before. However, not only the prosecutor but also this lawyer put pressure on me to change my expressed will.

It was only when I got up to leave the witness hearing, if this lawyer was also in the room, that he left the room. I repeat, he is not my defense attorney. He was appointed ex officio by the prosecutors, but he cannot perform that role against my will. If this person simulated my defense when the witnesses were examined in the criminal case against me, then it is an unprecedented crime because this person simulating my defense attorney together with the prosecutor burdens my defense and prevents me from questioning the witnesses being examined.

The fact that the prosecutor was fully aware that I refused the defense and expressly forbade the participation of this private person in the proceedings is confirmed by the fact that he invited me to attend the hearing of the witness, and why would he not have an obligation under the law if it were not for European conventions.

If my suspicions are proven, I will file criminal charges against both of them.

In order to enable me to participate effectively in the investigative procedure, I ask you to undertake the following

The order in question accuses me of misleading the public with statements in the show that the decision was made by the police management. Evidence against this can be found in the special prosecutor's office, which was submitted to the police department in response to my request, or in the case that was conducted against Zoran Lazović. Deliver them to me.

I am accused of misleading the public in the show (it is not stated which show), the evidence against this can be found in the statements of Belivuk and Miljković, which are in the files of the Special Prosecutor's Office against these persons. Copy and deliver the same.

I am accused of misleading the public by stating that Petar Lazović was on official duty when he made contacts with Radoj Zvicer's criminal organization.

Evidence against this claim is found in the official record of Saša Čađenović, where it was found that there was no criminal offense against Petar Lazović.

I am accused of not initiating criminal proceedings against Ljubo Milović. Evidence against this claim can be found in the files of the case established in the Special State Prosecutor's Office and in the secret surveillance measures against this person. To hear the witness Dragan Radović on these circumstances.

Send me copies of the files of the cases conducted against Milović. And invite me to attend the hearing of Radović.

I am being blamed for not having initiated proceedings against him Radoja Zvicer and others. The evidence against this claim is found in the files of criminal cases with the number 17/21, so it is necessary to copy it and deliver it to me. the order on the formation of a special investigative team that I brought, the prosecution's request to the court for the search of Radoj Zvicer's apartment and other premises, the record of the search and the like.

I am further accused of knowing the pins of Radoj Zvicer and these persons, as well as being familiar with the content of sky communications.

In order to collect evidence against this claim, it is necessary to call Saša Čađenović (he is not accused in the case against me), Dragan Radonjć and Milorad Žižić as witnesses.

I am accused of not having initiated criminal prosecution against Duško Roganović. Although the basic suspicion against this person stemmed from the statement of Milan Kankaraš, which he gave in his capacity as a citizen. Evidence against this claim can be found in the criminal case file and precisely in the statement given by Milan Kankaraš.

It is necessary that you provide me with a photocopy of the same, as well as a copy of the statements made by this person as a cooperating witness in two cases of the Special State Prosecutor's Office.

In connection with these facts, it is necessary that you call and question Saša Čađenović and Milorad Žižić as witnesses, and invite me to attend the hearing.

Finally, I am accused of purposefully giving this item to Sasa Čađenović in order to achieve the treatment of this person.

For evidence against, it is necessary to attract the case numbers from the field of organized crime that Saša Čađenović worked on before December 2, 2020, from January 1, 2020 to December 31, 2021, in which phase of the procedure they were in that period of time .

In addition, Milorad Žižić needs to be questioned about these circumstances, i.e. when Saša Čađenović started working with them on this case.

Now it is completely clear why prosecutor Šoškić and that private person organized the hearing's witnesses without my presence.

Everything I am looking for can be organized and obtained in two working days.

Please, in connection with the financial investigation that is being conducted against me as well, to be heard without delay.

My demands are a priori only due to the fact that I am on hunger strike from 6 am on April 14, 2024, so if these investigative actions are not carried out next week, I am not sure that I will be able to participate.

If you do not issue mandatory instructions to Prosecutor Šoškić, he will delay everything.

When what has been presented is realized, and that is a priority, I want to be heard in connection with the criminal charges that I filed against the prosecutor Šoškić, and in connection with the case of Ukrainian citizens, the case where he deprived an Italian citizen of his freedom.

I am asking to be called urgently to supplement the defense for the criminal offenses that are being charged against me.

Once again, due to my health condition, I request that I be urgently invited to supplement my defense by presenting new facts and circumstances.
