The desire to control institutions is stronger than the need to ensure a truly public service

For the illegal appointment of Boris Raonic at the head of the Public Service RTCG, the violation of the Supreme Court ruling declaring his appointment illegal, as well as the re-election of Raonic to the same position, which is now being investigated by the Basic State Prosecutor's Office and the Special State Prosecutor's Office - political parties do not advertise.
The loudest in silence are precisely those who criticized RTCG's work for years, and from whom the citizens expected to maintain the same principles and, as representatives of the citizens, react to the problems of the media house that is financed from the budget.
The recent events in RTCG, when certain members of the Council re-elected an illegally appointed director, are now being dealt with by the prosecution - due to non-compliance with the court verdict, but also due to the criminal offense of the management by which they encouraged the president and members of the RTCG Council to commit a criminal offense, failure to execute a valid and enforceable court order judgments and enabled the acquisition of illegal benefits to the illegally elected general director.
The media center, which filed two criminal charges, and for one of which Raonic, together with RTCG lawyer Zorica Đukanović and head of the legal department Želimir Mićović, was questioned yesterday, submitted a request to the political parties to publicly determine and condemn the ignoring of the final court verdict in To the RTCG Council.
Although executive director Goran Đurović submitted a letter on behalf of the Media Center ahead of the election - there is still no response from the "Europe Now" Movement, Democratic Party of Socialists, Social Democratic Party, Ura, Democratic Montenegro, New Serbian Democracy and Democratic People's Party.
In the letter, which they sent to political leaders before the election, it is emphasized that by disobeying court rulings, especially in important institutions for the democratization of Montenegro, a message is sent to the citizens that they do not have to respect the decisions of the courts and that they will not be called to account for that. .
The media center states that, if final decisions of the court are not respected, then Montenegro will enter anarchy.
Today RTCG ignored the court's decision, and tomorrow some other organs and institutions and citizens will - warns Đurović.
Service for service
When asked by Pobjeda why political parties do not advertise, and whether this means that the RTCG, as Raonic pointed out, is free from political influence, or is he saying that the situation is the opposite, Đurović replies that he believes that the leaders of political parties do not advertise "because they o satisfied with the fact that they can call the illegally elected General Director Raonic and ask for various services related to the program contents".
Raonic apparently gave and promised all party leaders space on TVCG, some on the Parliamentary channel (which at one time was a billboard for the President of the Bečić Assembly, contrary to the production plan), some to appear independently on the show "Okvir" as a non-parliamentary party and even today as a candidate for the Prime Minister (Milojko Spajić), to someone to directly broadcast receptions and handling of dignitaries (Dritan Abazović, Jakov Milatović), to someone to promote through the portal and Radio Montenegro their political views contrary to the foreign policy of Montenegro (Democratic Front) - he enumerated the reasons Đurović.
He points out that the leaders of the parties lack integrity and that the adoption and application of new media laws depend on them, on the basis of which the new RTCG Council and new management should be elected.
Their need to control institutions is stronger than the need to provide citizens with a professional Public Service - believes Đurović.
He hopes that the judicial authorities will correct the mistakes and discourage the recurrence of anarchy.
Also, I hope that citizens will punish those who destroy institutions with their attitude in the elections - he said.
Addressing parties
In the letter, which the Media Center addressed to the leaders of the political parties, they were invited to clearly and publicly decide on the refusal to implement the final judgment of the High Court.
If political parties, and especially those that make up the government or are pretenders to the exercise of power, remain silent about ignoring final judgments, then they become complicit in the collapse of the rule of law - the letter from the Media Center says.
That organization pointed out in its address that the silence of political parties as well as the procrastination of the prosecution's decisions sends a clear message to the citizens that neither they nor any long legal entities should respect the legally binding decisions of the courts.
When the Council of the RTCG and the illegally elected General Director Raonic do not understand that the consequence of their decision is that the RTCG no longer has any legitimacy to demand responsibility and review anyone's work, we expect your political party to show more understanding for the consequences of this act - it says, among other things, in a letter from the Media Center.
In its verdict, the High Court gave the Council two options as a legal recommendation - to announce a new competition or to of the remaining candidates who came forward in 2021, elect a new director.
The legal consequence of the annulment of the appointment decision is a re-election among the applied candidates or the annulment of the competition, in which the defendant has the opportunity to reconsider the remaining applications and to make a decision in accordance with the law - the judgment reads.
However, on June 1, the Council chose not to announce a new competition, but decided again between Nikola
Marković, Milutin Stijepović, Srđan Čović, but also Boris Raonic, which is in direct contradiction to the judgment of the High Court, which orders that in the repeated procedure, the selection can only be made from the remaining candidates.
Veselin Drljević (president), Filip Lazović, Naod Zorić, Predrag Miranović, Amina Murić took part in declaring the list of candidates. Four votes were for Raonic, and one ballot was invalid, that is, no candidate was selected.
Before the vote, the vice-president of the Council, Marijana Camović-Veličković, left the session, having previously announced that she would not participate in the decision-making if the majority in the Council, according to the suggestions of the legal service, still persisted, contrary to the court's decision, in not excluding Raonic from the list of candidates from the competition. which was announced on June 17, 2021.
She insisted that the court made it clear in its verdict what it thought about the election of Raonic in 2021 and that the issue should have been put to rest, instead of the legal interpretations of the lawyers representing RTCG in the dispute, who lost, and the legal advisor of the RTCG Council, is trying to enable Raonic to sit in the same seat again.
For the same reason, Milica Špajak was excluded from the secret ballot, who announced during the discussion that she would not participate if the prevailing attitude was to go to a vote on the appointment of the director from among the candidates, including Raonic. The session where Raonic was re-elected was not attended by Predrag Marsenić, nor by Bojan Baća, who resigned before the session.
On June 2, the Basic State Prosecutor's Office initiated a case regarding the re-appointment of Boris Raonic as General Director of RTCG, and on June 8, the Media Center submitted two applications, one of which is under the jurisdiction of the ODT, and the other was forwarded to the SDT.
In addition to that of the ODT, the SDT will also hear the report filed by the Media Center against the president and members of the RTCG Council, Veselin Drljević, Filip Lazović, Naod Zorić, Predrag Miranović, and Amina Murić, because as public officials they refused to execute the final and executive order. court verdicts and enabled the acquisition of illegal benefits to the illegally elected general director of RTCG, Boris Raonić.
The day before yesterday, Raonic avoided the press teams that were waiting for several hours in front of the Basic Court, in order to get a statement. However, even though he is the general director and manager of the largest state-owned media company, he avoided appearing in front of the journalists and in that way pointed out his relationship with the media, to which he also belongs. His reaction was not deserved by the citizens of Montenegro, who allocate around 17 million euros per year to the budget of that house. The teams were waiting in front of the two entrances of the Basic Court, to which he apparently did not go.
Invitation also sent to Milatović
Yesterday, the Media Center also sent an invitation to the President of Montenegro, Jakov Milatović, to condemn the RTCG Council's refusal to implement the final court decision.
The president promised in his inaugural speech that he would advocate for the respect of the constitutional principle of the rule of law, so we expect him to make a clear decision regarding the refusal to implement the final judgment of the High Court in the case of the illegal appointment of RTCG director general Boris Raonic - the invitation reads.
The media center also wrote to Milatović that in the event that he, like the political parties, feels that the final judgments are being ignored, then he becomes an accomplice in the collapse of the rule of law.
We believe that you may have an additional motive in this case, because as the Minister of Economic Development and a second-level authority, you prevented the Directorate for Inspection Affairs - Labor Inspection from verifying the legality of the appointment of Boris Raonic to the position of general director. I am taking this opportunity to inform you that the Administrative Court, to which the Media Center filed a lawsuit against the second-instance decision, has not considered this case even after almost two years - the Media Center reminded.
